General terms and conditions (GTC)

for seminars, trainings and instructions by Grothe Training
All services provided by Grothe Training within the scope of seminars, trainings and instructions are subject to the following conditions. Any general terms and conditions of the contractual partner shall not apply.
1. scope of services
Offer prices refer to the maximum number of participants stated in the offer . Costs for hotel, travel and catering of the participants are not included in the seminar and training fees, if they are not explicitly listed. The services described in the offer are provided by lecturers of Grothe Training. The agreed prices do not include value added tax at the applicable rate, unless expressly agreed otherwise. The services are provided by Grothe Training according to the contractual agreements. A certain success is not owed.
2. conclusion of contract
Seminars at Grothe Training must be booked in writing, by email, telephone or via the Grothe Training website. A binding contract is only concluded by written confirmation of the registration by Grothe Training.
3. withdrawal
In the event of cancellation of the seminar by the client, the following regulation applies:
In-House Seminar:
– until 7 days before the agreed date: 75%;
– if the participant does not appear, the full fee will be charged
Online Seminar:
– 75% for seminars organised at short notice (less than 3 days in advance)
– if the participant does not appear, the full fee will be charged
4. cancellation
Grothe Training reserves the right to cancel or postpone seminars for organisational and technical reasons (e.g. if the minimum number of participants, depending on the type of seminar, is not reached, or if a lecturer is temporarily absent, force majeure). In case of cancellation by Grothe Training, an attempt will be made to rebook the participants to another date, if the participant agrees. If the participant is unable to participate due to a postponement of the date, the contract can be cancelled and seminar fees already paid will be refunded. Further claims do not exist, except in cases of intentional or grossly negligent behaviour of legal representatives, employees or other vicarious agents of Grothe Training.
5. Payment
The participation fee is due at the end of the respective seminar and is payable within the period stated on the invoice. As a rule, the invoice states a payment term of 15 days after invoicing. A temporary participation in a seminar of Grothe Training does not entitle to a reduction. A set-off by the client against claims of Grothe Training from this contractual relationship is only possible insofar as the counterclaim is undisputed or legally binding. Otherwise, offsetting is not permitted.
6. equipment
During an online seminar of Grothe Training, the client must provide a stable internet connection, web-cam, a microphone, as well as loudspeakers for the participant, so that a proper, trouble-free course of the seminar is guaranteed. The client himself is responsible for meeting these requirements. Grothe Training is not obliged to check whether the client meets the necessary requirements. Grothe Training is not liable for defective or insufficient equipment on the part of the participants.
7. Copyright
Any working documents provided by Grothe Training are the property of Grothe Training and may not be reproduced or distributed, even in part, without the consent of Grothe Training. Grothe Training reserves all rights.
8. Disclaimer
Grothe Training always carries out the offered seminars, trainings and instructions according to the latest state of the knowledge to be imparted. Grothe Training is not liable for any possible misconduct of the participants in the exercise of their profession or in the private sphere after handing over a certificate or a certificate of participation.
9. Data protection
The data of the participants transmitted to Grothe Training by the client will not be passed on to third parties and will only be processed for handling the seminar booking. The copy of the identity card/passport required for the online seminar is required for identification of the participant by the instructor and will be deleted immediately after identification.
10. Personal rights
Possibly photos will be taken during the events, which may be used for advertising purposes by Grothe Training. The participants of the events will be informed of this at the beginning of the event. It is possible that the participants can also be recognised in these photos. If the participants do not agree with the creation and use of the photos, they must inform us at the beginning of the event. Otherwise, no claims for damages or injunctive relief or other claims based on Grothe Training’s use of the photographs shall exist at a later date.
